A special expenses clause the Maintenance Enforcement Program can enforce
The program collects only on a stated dollar amount that one party pays the other on stated dates. A percentage share on its own won't be enforced.
The parties shall share the special expenses for the children in proportion to their incomes, the Respondent paying 62% and the Applicant 38%.
- Shared, not paid to the other party
- A percentage, no dollar amount
- No dates, no end
From 1 November 2026, on the first of each month, the Respondent shall pay the Applicant $285 toward child care and speech therapy for [child's full name], until 31 August 2027.
- One party pays the other
- A dollar amount
- Dates and an end

Three things that trip people up
Put the amount in the clause itself, not only in a schedule.
"On presentation of receipts" isn't enforced for orders made since April 2014.
Annual recalculation must be written into the order; MEP can't recalculate.
